Background Check Disclosure & Authorization

1. Disclosure

As part of the membership application process, The Exchange Social Club obtains a consumer report (background check) about you from a consumer reporting agency, Checkr, Inc. ("Checkr"). This report may include, but is not limited to, identity verification, a Social Security number trace, a search of the national sex offender registry, and criminal history records, including county-level court records.

This report is obtained solely for the purpose of evaluating your eligibility for membership in a private social club, and for no other purpose. The report will be used by The Exchange's membership review process, and by no other party.

2. Authorization

By checking the corresponding consent box on our Apply page, you authorize The Exchange Social Club to procure a consumer report about you from Checkr for the purpose described above. You also authorize Checkr to provide that report to The Exchange.

This authorization remains valid for the duration of your application and membership, and may be relied upon for any subsequent background check The Exchange may need to conduct in connection with your continued membership, consistent with applicable law.

3. How Checkr Handles Your Information

You will provide your Social Security number, date of birth, and other identifying information directly to Checkr through its own secure platform — this information is never collected or stored by The Exchange. The Exchange receives only the final result of your background check (a status, not the underlying report contents) unless you separately request that more detail be shared with you.

4. Your Rights Under the Fair Credit Reporting Act

The FCRA gives you a number of rights with respect to consumer reports, including (in general terms):

  • The right to know if information in your file has been used against you.
  • The right to know what is in your file and to request a copy of your report.
  • The right to dispute incomplete or inaccurate information with the consumer reporting agency.
  • The right to have a consumer reporting agency correct or delete inaccurate, incomplete, or unverifiable information.
  • Limits on how long certain negative information can be reported.

5. If Your Application Is Declined Based on Your Report

If The Exchange decides not to approve your membership in whole or in part because of information in your background check report, you will be notified and given the opportunity to review the report and dispute its accuracy before a final decision is made, consistent with the FCRA's adverse action process.
