Membership Agreement & Terms

1. Acceptance of These Terms

By submitting a membership application, paying any associated fees, or attending any event hosted by The Exchange Social Club ("The Exchange," "we," "us"), you agree to these Membership Terms, our Code of Conduct, and our Privacy Policy. If you do not agree, do not apply for or use a membership.

2. Nature of the Club

The Exchange is a private social club for the adult lifestyle and swinger community. Events may include nudity and consensual sexual activity between members. By becoming a member or guest, you acknowledge that you may observe, and may choose to participate in, such activity, and you consent to being present in an environment where it occurs.

Participation in any activity beyond simple attendance and observation is entirely voluntary. Nothing in these Terms obligates any member to engage in any activity they do not wish to engage in, and all interaction between members is governed by the consent principles in our Code of Conduct, which is incorporated into this Agreement by reference.

3. Eligibility

  • You must be at least 21 years of age.
  • You must complete and pass the application and verification process described in Section 5.
  • Membership is intended for consenting adults. The Exchange reserves the right to decline or revoke membership at its discretion.

4. Membership Tiers & Fees

Current membership tiers, pricing, and billing cadence are listed on our Membership page and may be updated from time to time. Founding Member dues are billed annually and locked at the rate in effect when you join. Couple and Single memberships are billed monthly. Guest Passes are single-use and require sponsorship by an existing member.

5. Application, Verification & Approval

All applicants must submit a membership application, pay the non-refundable Application & Verification Fee described on our Apply page, and complete an identity and background check through our screening partner, Checkr. Details on what this check involves are provided in our Background Check Disclosure & Authorization. The Exchange may decline any application at its sole discretion.

6. Code of Conduct

All members and their guests must comply with our Code of Conduct at all times while attending an Exchange event or location. Violation of the Code of Conduct may result in immediate removal and/or termination of membership without refund.

7. Guests & Sponsorship

Members may sponsor guests via a Guest Pass, subject to the limits described on our Membership page. A sponsoring member is responsible for the conduct of their guest while on Exchange premises and acknowledges that guests are not independently background-checked in the same manner as members — sponsorship is a substitute for, not a supplement to, independent vetting.

8. Private Spaces

The Exchange may make private rooms or spaces available to members for their use. Use of private spaces is at members' own discretion and subject to posted rules (including, where applicable, signals or locks indicating a space is occupied, which must be respected by all members). Specific operating rules for private spaces are still being finalized and will be communicated to members in advance of use.

9. Alcohol & Bar Service

The Exchange holds a Mixed Beverages permit and operates a full bar serving cocktails, spirits, wine, champagne, beer, and cider. All alcohol is served by licensed bar staff in accordance with North Carolina ABC regulations. You must be 21 or older and present valid ID to be served.

Members are welcome to bring their own wine or champagne (a corkage fee applies per our current bar menu) and their own beer at no additional charge. Outside spirits and liquor may not be brought onto the premises under any circumstances.

Members and guests are expected to drink responsibly. The Exchange reserves the right to refuse service to anyone who appears intoxicated, and to remove any member or guest whose conduct is impaired. Alcohol consumption does not excuse or mitigate violations of the Code of Conduct, including and especially the consent requirements in Section 10.

10. Consent & Assumption of Risk

You acknowledge that attendance at, and participation in, Exchange events carries inherent personal risks, including but not limited to risks associated with nudity, sexual activity, and interpersonal interaction between adults. By participating, you voluntarily assume these risks.

All physical and sexual contact between members must be based on clear, affirmative, and ongoing consent from every party involved. Consent to one activity does not imply consent to any other, and consent may be withdrawn by any party at any time, for any reason, without consequence. Members are expected to respect a withdrawal of consent immediately and without argument.

To the fullest extent permitted by law, you release The Exchange, its owners, operators, and staff from liability for the voluntary conduct of other members, while retaining all rights and remedies available to you under applicable law in the event of non-consensual conduct, which is a serious violation of our Code of Conduct and may also be unlawful.

11. Discretion & Confidentiality

Discretion is fundamental to membership. Members agree not to photograph, record, or disclose the identity, attendance, or activities of any other member without that member's express consent. Phones and cameras are not permitted on the floor during events.

12. Payment, Billing, Pausing & Cancellation

Membership dues are billed automatically on the cadence selected at signup. Members may pause a monthly membership or cancel at any time by contacting membership@exchangesocialclub.com. The Application & Verification Fee is non-refundable under all circumstances, as described on our Apply page.

13. Termination of Membership

The Exchange may suspend or terminate any membership, at any time, for violation of these Terms or the Code of Conduct, for conduct that endangers another member, or at its sole discretion. No refund of paid dues is owed upon termination for cause.

14. Limitation of Liability

To the maximum extent permitted by law, The Exchange's liability arising from your membership or attendance at any event is limited, and The Exchange disclaims liability for the independent acts of members, contractors, and third parties, except as expressly provided in Section 10 regarding non-consensual conduct.

15. Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles.

16. Changes to These Terms

The Exchange may update these Terms from time to time. Continued membership after an update constitutes acceptance of the revised Terms.
